Terms of Use

These terms apply to The Hotel Cat, the app and this website (the "service"), provided by Erdal Irmak, an independent developer and not a company ("we", "us"). By using the service you agree to them. If you do not agree, please do not use it.

1. The service

The service lets you enter a personal rating of a hotel or restaurant and creates a video card that you can save and share. It is a tool. We do not publish, review, verify or endorse the cards that people create with it.

2. Who may use it

You must be at least 13 years old (or the higher minimum age in your country) and able to accept these terms. Where you are under the age of majority, you confirm that a parent or guardian allows your use.

3. Cards are your content and your responsibility

You alone are responsible for everything you type into a card (venue names, locations, names, ratings) and for every card you create, save, or share.
We are not responsible for cards created or shared with the app, or for anything that results from them.
A card should reflect your honest personal opinion and experience. Do not create cards that are false, misleading, defamatory, hateful, unlawful, or that infringe someone's rights, that impersonate anyone, that contain personal data of others, or that you were paid or pressured to make without saying so.
Ratings and words on a card are personal opinions of the person who created it. They are not statements, facts, or recommendations by us.
We have no affiliation with the venues, brands, or platforms named in or used with cards.

4. Sharing

The app hands your video to the share target you pick. After that, the other app's rules apply (for example, TikTok, Instagram, or messaging apps). We cannot recall, edit or remove videos that have been shared or saved outside our servers.

5. Licence to card data we receive

You keep ownership of your content. For card data that the app sends to our servers, you give us a worldwide, non-exclusive, royalty-free licence to store, process, analyze, and make it available to businesses and in statistics as described in the Privacy Policy. This licence lasts as long as we hold the data.

6. Removal

We may hide, remove or anonymize any card record on our servers at any time, for example if we think it breaks these terms or the law. If you believe a card is unlawful or infringes your rights, email support@thehotelcat.com with the venue name, date, and a description of the problem, and we will review it. Please contact the person who shared the video as well, since we cannot remove copies outside our servers.

7. Acceptable use

Do not misuse the service: no attempts to break, overload or reverse engineer the servers or app (except where the law allows), no automated or fake uploads, and no use to harass others.

8. Intellectual property

The app, its design, and the "The Hotel Cat" name belong to us. The app is licensed to you for personal, non-commercial use. Third-party names and trademarks, including Google Play, belong to their owners.

9. No warranty

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, including accuracy, availability, fitness for a particular purpose and non-infringement. We do not promise that the service will be uninterrupted or error-free, or that video creation will work on every device.

10. Limit of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, goodwill or reputation, arising from your use of the service or from any card, and our total liability for any claim is limited to the amount you paid us for the service (which is zero if the service was free). Nothing in these terms excludes liability that cannot be excluded by law, or limits mandatory consumer rights in your country.

11. Your indemnity

To the extent permitted by law, you will defend and hold us harmless against claims, damages, and costs (including reasonable legal fees) that arise from a card you create or share, or from your breach of these terms.

12. Changes and ending

We may change the service or these terms. The date above shows the latest version, and continued use means you accept it. You can stop using the service at any time by uninstalling the app. We may suspend or stop the service or your access.

13. Governing law

These terms are governed by the laws of the Republic of Türkiye. Courts in Istanbul have jurisdiction, without taking away the mandatory consumer protection rights or court options that you have in your country of residence.
